Public offer to enter into a software license agreement

1. General provisions

1.1. This document is an offer by Турков Егор Владимирович, taxpayer ID 745210827802 (the “Licensor”), to enter into a license agreement with any legally capable individual (the “User”) on the terms below.

1.2. Selecting acceptance of this offer and paying for the license constitutes full and unconditional acceptance. The agreement is formed when the payment provider confirms successful payment.

1.3. Before payment, the User must review the product description, system requirements and this offer. Mandatory consumer protection law prevails over these terms.

2. License

2.1. The Licensor grants a simple (non-exclusive), non-transferable license for the selected 404 Tools product: Text Motion 404 for Adobe Premiere Pro and After Effects or Object Motion 404 or Draw Motion 404 for Adobe Premiere Pro (the “Software”). New Motion Pack 404 purchases after publication of the Halloween update include separate licenses for Text Motion 404, Object Motion 404 and Draw Motion 404. Previous orders retain their purchased Text + Object bundle; Draw is not added automatically.

2.2. The license is worldwide for the term of the exclusive rights and permits one User to install and activate the Software on one computer owned by that User. After first successful activation, the key is bound to that computer and is not automatically transferable.

2.3. The Software may be used in personal and commercial editing projects. The Licensor receives no rights to video materials created by the User.

2.4. Rights to the Software, source code, design and documentation are not transferred. Distribution of the key or Software copies, resale, transfer to third parties, removal of ownership notices and circumvention of protection are prohibited to the extent permitted by law.

2.5. Limited Free editions of Text Motion 404, Object Motion 404 and Draw Motion 404 are available without payment or a key. Payment unlocks the corresponding PRO edition without reinstalling. Draw Motion FREE export contains a baked-in watermark and is limited to 3 seconds of animation; PRO removes the watermark, allows up to 30 seconds and unlocks the drawing library.

3. Functionality and requirements

3.1. Text Motion 404 creates animated text and subtitles. Object Motion 404 creates Scale and Position animation through the Transform video effect. Draw Motion 404 creates drawings and transparent animations over video in Premiere Pro. Current functionality is described at https://textmotion404.ru.

3.2. Compatible Adobe Premiere Pro 2020–2026 versions are supported, and Text Motion 404 also supports After Effects 2020–2026, on Windows 10, Windows 11 and compatible current versions of macOS. Internet access is required for download, initial activation and periodic signed-token renewal.

3.3. The User is responsible for a compatible licensed Adobe application and computer. 404 Tools products are not Adobe products and the Licensor does not act on Adobe’s behalf.

4. Price and payment

4.1. The fee for the selected PRO license or Motion Pack 404 bundle is displayed on the product page and immediately before payment. The checkout price accepted by the User applies.

4.2. Payment is one-time and is processed through YooKassa or Lava.top using methods available on the relevant checkout page. Payment is complete when confirmed by the selected provider.

4.3. The Licensor applies the Russian professional-income tax regime and issues receipts where required by applicable law.

5. Delivery and activation

5.1. After confirmation, the license key, download links and setup guide are sent automatically to the e-mail address entered by the User. New Motion Pack 404 orders are delivered with three separate keys, one per product. Previous Text + Object bundles retain two keys.

5.2. Delivery normally takes a few minutes. If delayed, check Spam and contact support@textmotion404.ru.

5.3. Delivery is complete when the key and working download link are sent to the provided address. An e-mail typo will be corrected after the User contacts support and the purchase is verified.

5.4. Updates in the 1.x line are included. A new major version may be offered under separate terms.

6. Support, defects and refunds

6.1. Installation, activation and reproducible-error support is available at support@textmotion404.ru. Include the operating system, Adobe application and version, Software version and reproduction steps.

6.2. If the Software materially differs from its published description or contains a defect, the Licensor will within a reasonable time provide a fix, working replacement or another remedy required by law.

6.3. Cancellation or refund requests must be sent to support@textmotion404.ru with the purchase e-mail and reason. Requests are handled under applicable law; these terms do not limit non-waivable consumer rights.

6.4. Incompatibility clearly disclosed before payment is not by itself a defect, but every request is reviewed according to its facts and applicable law.

7. Liability

7.1. The parties are liable for breach under Russian law.

7.2. The Licensor is not responsible for failures of Adobe applications, the operating system, third-party extensions, hardware, network or User modifications to Software files. This does not exclude liability for the Licensor’s own fault or Software defects.

7.3. The User must protect the key. A compromised key may be blocked and replaced for a verified good-faith buyer.

8. Personal data and electronic messages

8.1. E-mail, payment information, installation identifier and activation diagnostics are processed to accept payment, issue and protect the license, provide support, send receipts and comply with law.

8.2. Necessary data may be shared with payment, e-mail and hosting providers only to perform the agreement. Marketing messages are not sent without separate consent.

9. Disputes and changes

9.1. Claims may be sent to support@textmotion404.ru. The Licensor seeks voluntary resolution; the User retains all rights to contact competent authorities or courts.

9.2. Russian law applies. Nothing here limits statutory consumer choice of venue.

9.3. A new offer version applies to payments made after publication and does not lawfully worsen previously concluded agreements.
